Terms & Conditions of Sale (General Conditions of Sale), effective from May 24, 2023.

 

PREAMBLE

This information is provided for the website https://20zero3.com/ (the “Site”).

Article 1 – Scope of Application

 

1.1 These General Conditions of Sale apply to all purchases made from the Seller through the Site.

1.2 If the Site allows entry of a tax code (codice fiscale) at purchase, you are considered a Consumer pursuant to Article 3(1)(a) of the Italian Consumer Code (Legislative Decree 206/2005). A Consumer is a natural person acting outside of professional or business activities. If you enter a VAT number, the purchase is treated as made by a Professional (Article 3(1)(c) Consumer Code). Implications vary depending on whether you’re a Consumer or Professional, described later herein.

1.3 Terms like “days” refer to business days, excluding weekends and national holidays. Images and descriptions on the Site are indicative; actual colours may vary due to device differences.

1.4 The General Conditions may be updated at any time; updates take effect upon publication. You are encouraged to check them before making a purchase.

1.5 Applicable conditions are those in effect at the time your order is placed.

1.6 These Conditions do not govern the sale of third-party products/services linked via the Site.

1.7 You should review the third party’s own terms before purchasing from them.

1.8 The Seller is not responsible for products/services provided by third parties.

1.9 The Seller does not monitor their content and is not liable for any errors or omissions.

1.10 You must carefully read these Conditions and all information provided during checkout.

1.11 The Seller is not liable for indirect, incidental, or consequential damages, including lost profits, or for website reliability or accuracy.

1.12 Unless otherwise agreed, orders cannot be placed via email or phone.

 

 

Article 2 – Purchases on the Site

 

2.1 Orders are placed via the Site’s purchasing procedure. The contract is concluded when the order reaches the Seller’s server.

2.2 You must inform the Seller immediately if you suspect misuse of any information you provide.

2.3 You guarantee that personal data is accurate and indemnify the Seller from damages related to false data. Report any credential misuse immediately.

2.4 The Seller reserves the right to refuse orders from customers who previously violated these terms.

2.5 Orders require acceptance of these Conditions via checkbox; failure to do so prevents purchase.

2.6 The Seller is the sole contracting party and assumes all pre-contractual and contractual obligations.

2.7 References to “we” or the Seller on the Site refer to the Seller itself.

2.8 The Seller does not guarantee uninterrupted Site operation.

2.9 After purchase, you will receive a confirmation email with: (i) Seller details; (ii) product characteristics; (iii) total price including taxes; (iv) any extra charges; (v) withdrawal rights or exceptions; (vi) shipping address; (vii) payment method.

2.10 Product colours are indicative; discrepancies due to screen differences are not Seller’s responsibility. Contact the Seller if in doubt.

 

Article 3 – Product Availability

 

3.1 Products are limited in stock and may become unavailable after order placement.

3.2 Availability is continuously updated, but simultaneous orders may cause stock issues.

3.3 If a product is unavailable, you may:

    •    Resolve the contract;

    •    Accept a replacement of equal or greater value (extra charge may apply);

    •    Receive a discount voucher;

    •    Accept delayed delivery.

3.4 Refunds for unavailable products are issued within 7 days.

3.5 Exercising a withdrawal resolves the contract; any payment already made (product price + shipping + extras) will be refunded per the “Payment Methods” article.

 

 

Article 4 – Prices

 

4.1 Prices include VAT.

4.2 RAEE environmental disposal fees are not included as products are exempt.

4.3 Prices may change anytime, but your order price is fixed at the time of purchase.

4.4 Shipping costs, if any, are displayed at purchase or on product pages.

4.5 Products ship only after payment confirmation. Ownership transfers to you at dispatch; risk passes at delivery to you or your designee.

4.6 Orders are contingent on payment; non-payment leads to cancellation.

4.7 If a pricing error occurs, the Seller may inform you of the correct price; you can accept or cancel. The Seller can also cancel in case of availability errors.

 

 

Article 5 – Payment Methods

 

5.1 Available payment methods are described here; contact Seller for alternatives.

5.2 Payments by credit/debit card are processed after card issuer authorization. PSD2 Strong Customer Authentication may apply. Card details are encrypted and not stored by the Seller. Accepted cards: Visa, MasterCard, American Express, PostePay.

5.3 Bank transfer is not supported.

5.4 Cash on delivery is not available unless agreed in writing.

5.5 If a discount code’s value is lower than order total, the remainder must be paid by other methods. Vouchers are single-use and non-redeemable for cash.

5.6 Alternate payment methods are described here. PayPal is available: you will be redirected to PayPal for payment, and Seller won’t receive your PayPal card information.

5.7 Per Legislative Decree No. 26/2023, prices are fixed and not personalized via automated decisions.

5.8 During a discount, the Site displays the lowest price from the past 30 days. This doesn’t apply to “launch prices.”

 

 

Article 6 – Delivery

 

6.1 Delivery is available within Europe. Contact Seller for other regions.

6.2 Delivery obligation is fulfilled when you receive material control of the product.

6.3 Estimated delivery is 5 days from ordering.

6.4 This is indicative; delivery may be delayed up to 30 days. Check product condition upon receipt and note any damage on carrier documents.

6.5 Home pickup points are not currently available.

6.6 In-store pickup is available where indicated. You will be notified when the item is ready.

 

 

Article 7 – Right of Withdrawal

Article 8 – Statutory Warranty of Conformity

 

8.1 Warranty applies only to Consumers, not Professionals.

8.2 The Seller is liable for conformity defects within 2 years of delivery; claims must be made within 26 months.

8.3 Defects appearing within 12 months are presumed existing at delivery. After 12 months, the burden of proof is on the Consumer.

8.4 For non-conformity, you may request repair, price reduction, or contract resolution under Consumer Code Articles 135‑bis and following.

8.5 The Seller is not responsible for damage from improper use or force majeure.

8.6 For Professionals, the warranty follows Civil Code Articles 1490+, with an 8‑day complaint period and 1‑year limitation.

 

 

Article 9 – Manufacturer’s Warranty

 

Any additional manufacturer warranty is supplementary; unless stated on the Site, Seller does not provide it. Legal conformity warranty still applies.

 

 

Article 10 – Governing Law & Jurisdiction; ADR/ODR

 

10.1 Contracts are governed by Italian law.

10.2 EU Consumers can rely on more favorable mandatory laws in their country.

    •    Consumers: disputes are handled in their place of residence or domicile.

    •    Professionals: jurisdiction is Bologna, Italy.

10.3 If a complaint is not resolved, Seller will provide ADR contact info.

10.4 EU Consumers can use the EU online dispute resolution (ODR) platform at http://ec.europa.eu/consumers/odr.

10.5 Consumers may also pursue ordinary court even after ADR/ODR.

10.6 Residents of other EU countries can access small claims procedures up to €5,000 per Regulation (EC) No. 861/2007.

 

 

Article 11 – Customer Service

 

11.1 Contact Seller via details in the Preamble or Site form.

11.2 Response time is approximately 3 days.

 

 

Article 12 – Reviews

 

12.1 Per Legislative Decree No. 26/2023, reviews are not enabled on the Site.

12.2 Check this article in future purchases to see if reviews are added.

 

 

Article 13 – Miscellaneous

 

13.1 These Conditions fully govern the relationship with the Seller. Mandatory legal rights remain unaffected.

Article 12 – Gift Cards

 

Gift Cards are valid only for purchases at 20zero3.shop or the store, and are valid for 3 years. After expiration, unused balance is non-refundable and cannot be converted to cash. Lost, stolen, or damaged cards will not be replaced. Use of Gift Cards implies acceptance of their terms, available at purchase and in-store.
