Right of Withdrawal
The User is invited to read this section carefully, as it governs the right of withdrawal.
The right of withdrawal is the Consumer’s right to terminate the purchase contract without being required to provide any reason. If you have purchased as a Professional, the right of withdrawal does not apply, unless otherwise agreed with the Seller. Any exceptions to the right of withdrawal are set out in this Article 7. If there are no exceptions to the right of withdrawal, this Article 7 shall apply in full.
-
The Website sells goods made to measure or clearly personalised. If you are acting as a Consumer, the following provisions on the right of withdrawal do not apply by specific provision of law. Otherwise, the Seller would be unable to resell a Product specifically made for you.
-
If you are a Consumer (and provided that none of the exceptions set out in this Article apply), you have the right to withdraw from the purchase contract for the Product without providing any reason and without incurring any costs other than those specified in this Article, within fourteen calendar days (Withdrawal Period). To exercise your right of withdrawal, you must inform the Seller of your decision to withdraw before the Withdrawal Period expires. For this purpose, you may contact the Seller using the contact details indicated in the Introduction, or use the contact form, if available, on the Website. You have exercised your right of withdrawal within the Withdrawal Period if the communication concerning the exercise of the right of withdrawal is sent before the Withdrawal Period expires.
Unless otherwise agreed, the direct costs of returning the Products shall be borne by the Consumer, who shall also be responsible for the transportation of the Products. In the event of withdrawal, the Product must be delivered to the Seller’s premises or to another address communicated by the Seller.
The Withdrawal Period expires after 14 days:
-
in the case of an order relating to a single Product, from the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the Products;
-
in the case of a Multiple Order with separate deliveries, from the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last Product; or
-
in the case of an order for the delivery of a Product consisting of multiple lots or pieces, from the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last lot or piece.
If the right of withdrawal applies, the Seller shall refund the Total Amount Due, including delivery costs, where applicable, without undue delay and in any event no later than 14 calendar days from the day on which the Seller was informed of the decision to withdraw from the contract.
The refund shall be made using the same means of payment used for the original transaction. If the Products were shipped using a carrier chosen by the Consumer and at the Consumer’s expense, the Seller may withhold the refund until the Products have been received or until the Consumer has provided evidence that the Products have been returned, whichever occurs first.
The Consumer shall only be liable for any decrease in the value of the goods resulting from handling the Product other than that necessary to establish its nature, characteristics and functioning.
In any event, the Product must be stored, handled and inspected with ordinary care and returned intact, complete in all its parts, in perfect working order, together with all accessories and information leaflets, with identification tags, labels and the single-use seal, where applicable, still attached to the Product and intact and untampered with. The Product must also be perfectly suitable for its intended use and free from any signs of wear or dirt.
The right of withdrawal also applies to the Product as a whole. It therefore cannot be exercised in relation to individual parts and/or accessories of the Product.
If the Product for which the right of withdrawal has been exercised has suffered a decrease in value resulting from handling other than that necessary to establish its nature, characteristics and functioning, the Seller reserves the right to deduct from the refund an amount corresponding to such decrease in value.
The Seller shall inform the Consumer of this circumstance and of the resulting reduced refund amount. If the refund has already been paid, the Seller shall provide the bank details required for payment of the amount owed by the Consumer as a result of the decrease in the value of the Product.
If the right of withdrawal has not been exercised in accordance with the applicable legislation, it shall not result in termination of the contract and, consequently, shall not give rise to any right to a refund.
Where the right of withdrawal applies, the Products must be returned to the address indicated in the “Seller’s Details” section of the Introduction, or to the address communicated by the Seller from time to time.
This Article governs a particularly important matter concerning the costs of returning Products in the event of withdrawal.
In light of the above, the Seller considers it appropriate to emphasise that the costs of returning the Product shall be borne by you and shall be your responsibility.
